   That looks like a Palm Warbler to me. They are in your range over the winter.

   Frank T. is correct. The bird in the photo is a Palm Warbler which is common in Florida in the winter. In twenty years of birding in Florida I have never seen a Tree Sparrow. I lived in NY for many years and Tree Sparrows occurred in the winter.
